Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes the kinds of content and behavior that are not allowed on befridgeworthy.com or in connection with our products and services. It is part of, and incorporated into, our Terms of Service.

By using the Services or submitting any content, you agree to follow this AUP.

1. Content You May Not Submit

You may not upload, link to, or otherwise submit any content that:

Sexual or exploitative content

  • depicts sexually explicit material, nudity in sexual contexts, or pornographic content;
  • sexualizes minors in any way, or depicts minors in any sexual, suggestive, or compromising context. This is an absolute prohibition with zero tolerance.

Violence, harm, or hate

  • depicts graphic violence, gore, mutilation, or torture;
  • promotes, glorifies, or encourages self-harm, suicide, or eating disorders;
  • promotes hate, harassment, or discrimination based on race, ethnicity, national origin, religion, disability, age, sex, gender identity, sexual orientation, or other protected characteristic;
  • threatens, harasses, or intimidates any individual or group;
  • depicts or promotes terrorism, organized violence, or extremism.

Illegal activity

  • depicts or facilitates illegal drug use, weapons trafficking, or other criminal activity;
  • depicts or promotes child abuse in any form;
  • violates any applicable law or regulation.

Intellectual property and rights of others

  • infringes copyright, including copyrighted characters, logos, brand artwork, film and TV stills, album covers, song lyrics, sheet music, sports league imagery, or any other protected work, unless you hold the rights or have express permission;
  • infringes trademarks or trade dress;
  • violates a person's right of publicity (e.g., using a celebrity's likeness on merchandise without permission);
  • contains another person's identifiable image without their permission, particularly in private, intimate, or embarrassing contexts;
  • discloses or encodes private personal information (e.g., addresses, phone numbers, government ID numbers) of any person without their consent.

Deceptive or harmful technical content

  • contains malware, viruses, or code designed to disrupt or damage systems;
  • attempts to bypass security, scrape data, or interfere with the Site or Services;
  • impersonates any person, brand, or organization or misrepresents your affiliation.

2. NFC-Linked Content — Audio

The same content restrictions apply to any audio you submit to be linked to an NFC-enabled product. You must have the rights to all submitted audio (your own recording, recordings you have permission to use, music or audio you have a license to reproduce, etc.). Audio that violates this AUP — including audio that defames, harasses, or threatens a third party, or that infringes copyright in music or other recorded works — is not permitted.

3. NFC-Linked Content — Contact, Business, and B2B Data

For NFC products that encode information such as phone numbers, website URLs, business addresses, location data, vCard-style contact records, social profiles, or similar — including our B2B and business-card-style products — the following apply:

3.1 Your own information. You may encode your own business or personal contact information freely.

3.2 Third-party contact information. If you encode another person's contact information on a tag (for example, the personal phone number of a colleague or a client's address), you must have that person's permission to do so. You represent and warrant that all such permissions have been obtained.

3.3 Linked destinations. NFC tags may not redirect to:

  • phishing or credential-harvesting sites,
  • sites distributing malware, ransomware, or other harmful software,
  • fraudulent commercial schemes, pyramid schemes, or scams,
  • sites that violate any other provision of this AUP, or
  • destinations that violate applicable law.

3.4 Accuracy. You are responsible for the accuracy of any contact information, address, or other data you submit to be encoded. We will not be liable for misrouted communications, missed appointments, or other issues caused by inaccurate data you provided. For B2B and business-card-style products, you assume all risk for business consequences of inaccurate or outdated encoded data, including lost transactions, missed business opportunities, misrouted client inquiries, and reputational harm. We recommend reviewing your encoded content carefully before production.

4. NFC Tag Programming, Locking, and Rewriting

NFC tags are programmed by FridgeWorthy at production. Depending on product type, tags may be shipped locked (read-only and not user-rewritable) or unlocked (user-rewritable using third-party NFC-writing tools).

  • Do not rewrite tags with content that violates this AUP, including any of the content categories in Sections 1, 2, and 3.
  • FridgeWorthy is not responsible for tag content or behavior after a tag has been physically rewritten by you or a third party.
  • Any reprint, support, or warranty obligation associated with a tag is void once that tag has been rewritten outside of FridgeWorthy.
  • For products that use a FridgeWorthy-hosted redirect, we may, at our discretion, deactivate the redirect if we become aware that the content it points to has been changed in violation of this AUP.

5. Content Hosting and Persistence

FridgeWorthy hosts NFC content (audio, contact records, etc.) through our file hosting provider so your tag continues to work. We retain this content for as long as we operate the Services, subject to the terms in our Privacy Policy. You should maintain your own copies of irreplaceable content. We are not a backup service.

6. Our Review and Enforcement

We reserve the right (but have no obligation) to review submitted content before, during, or after production. We may:

  • refuse, cancel, or pause any order containing content we reasonably believe violates this AUP;
  • decline to host or redirect to NFC-linked content we reasonably believe violates this AUP or applicable law;
  • deactivate NFC redirects or remove hosted content with or without notice;
  • suspend or terminate accounts that repeatedly or seriously violate this AUP;
  • report content to law enforcement when required by law (including suspected child sexual abuse material, which we are required to report to the National Center for Missing & Exploited Children).

Our review is not a guarantee of the legality or appropriateness of any content; you remain responsible for everything you submit. Consistent with our Reprints & Replacements Policy and Terms of Service, we do not issue cash refunds, but at our discretion we may, in cases where we refuse or cancel an order before production, offer credit toward a future order.

7. Copyright Complaints (DMCA)

If you believe content on our Site or in our products infringes your copyright, please send a written notice that includes:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work you claim has been infringed.
  3. Identification of the material that is claimed to be infringing and where it is located (including a URL where applicable, or order details).
  4. Your contact information (name, address, phone, email).
  5. A statement, under penalty of perjury, that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Send the notice to our designated agent:

DMCA Agent — FridgeWorthy LLC Email: dmca@befridgeworthy.com

We may forward your notice to the user who submitted the content. We may terminate the accounts of repeat infringers.

If you believe content was removed in error, you may submit a counter-notice with similar information, as set forth in 17 U.S.C. § 512(g).

8. Reporting Violations

If you see content, NFC-linked media, NFC-linked destinations, or behavior that you believe violates this AUP, please contact us at safety@befridgeworthy.com. Include as much detail as possible (order number, URL, NFC tag identifier if known, description). We take reports seriously and will investigate.

9. Changes to This Policy

We may update this AUP from time to time. The "Last Updated" date reflects the most recent revision. Material changes will be communicated through the Site or by email where appropriate.
